Send a legal notice

A formal written demand, in your own name, is often enough to get your money back. Pick what you're owed.

How a legal notice works

  1. Write it: who you are, what happened, the amount in figures and words, the law, and a deadline (usually 15 days).
  2. Send it: by Registered Post A.D. or Speed Post, keeping the receipt and the A.D. card. Email or WhatsApp a copy too.
  3. Wait: many disputes settle here. If not, the notice and its proof of delivery support your case before the civil court, Rent Authority, labour authority or consumer commission.

When to use a lawyer instead

If the amount is large, the other side has already replied through an advocate, you have been served a notice yourself, or the deadline to file a case is close, talk to an advocate before sending anything.

Subject: Legal notice for refund of security deposit

Sir/Madam,

  1. I was your tenant at Flat 302, Sunrise Apartments, Baner, Pune 411045 under a rent agreement dated 01-06-2025, at a monthly rent of ₹18,000.00.
  2. At the start of the tenancy I paid you a refundable security deposit of ₹54,000.00 (Fifty Four Thousand Rupees Only).
  3. I vacated the premises and handed over vacant possession on 15-09-2026. All rent up to that date has been paid, except as adjusted below.
  4. You have sought to withhold the deposit on the following ground(s): repainting the entire flat. These are not lawful deductions, being normal wear and tear or otherwise unsupported by any bill or proof.
  5. Without admitting any liability, I accept the following deductions: ₹2,500.00 towards unpaid rent / dues, totalling ₹2,500.00. The balance of my deposit is therefore ₹51,500.00 (Fifty One Thousand Five Hundred Rupees Only).
  6. The security deposit was paid only as security for the tenancy and is refundable when the tenancy ends and possession is handed back, after adjusting lawful dues such as unpaid rent or the cost of repairing damage beyond normal wear and tear. This follows from the rent agreement and the law applicable to the tenancy. Withholding it after I have vacated is wrongful retention of my money.
  7. I therefore call upon you to refund the balance security deposit of ₹51,500.00 (Fifty One Thousand Five Hundred Rupees Only) within 15 days from the date of this notice, that is, on or before 26-10-2026, by bank transfer / UPI / cheque to me, and to confirm in writing.
  8. If you fail to do so, I may initiate appropriate proceedings against you before the appropriate civil court or, where the tenancy law of the State provides for one, the Rent Authority, to recover the amount with interest, compensation and costs, entirely at your risk as to costs and consequences.
  9. A copy of this notice is retained by me for further action.
