Defective product, failed service or a refund that never came? Send the seller a formal notice before going to the consumer commission.

Sending together (a joint deposit, a couple)? Add the others. The notice says "we" and each signs.

Leave "Refund you want" blank to ask for the full amount paid.

How to send it

  • Print, sign every page and keep a photocopy.
  • Send it by Registered Post A.D. or Speed Post to the address above. Keep the postal receipt and, when it comes back, the A.D. card.
  • Also send a scanned copy by email or WhatsApp. It's a quick extra record, not a replacement.
  • Wait for the deadline. Note any reply or payment.
  • Free mediation: call the National Consumer Helpline 1915 or register a grievance at consumerhelpline.gov.in.
  • If ignored: file a complaint yourself on e-Jagriti. No lawyer is needed. Claims up to ₹50 lakh go to the District Commission. File within 2 years.

Bought on Amazon, Flipkart or another marketplace? Send it to the seller and the platform's grievance officer too (listed on the site).

Sir/Madam,

  1. On [Date of purchase] I purchased / availed [Product or service] from you and paid [Amount paid].
  2. However, [what went wrong: defect, non-delivery, refund refused…].
  3. I have complained to you, but you have failed to resolve the matter.
  4. Under the Consumer Protection Act, 2019, a consumer who receives defective goods or deficient service, or is subjected to an unfair trade practice, is entitled to seek a refund, replacement or removal of the defect, along with compensation for the loss and harassment caused. Your acts amount to deficiency in service and/or an unfair trade practice.
  5. I therefore call upon you to refund [Amount] within 15 days from the date of this notice, that is, on or before 26-10-2026, by bank transfer / UPI / cheque to me, and to confirm in writing.
  6. If you fail to do so, I may initiate appropriate proceedings against you before the District Consumer Disputes Redressal Commission (or other Commission having jurisdiction) under the Consumer Protection Act, 2019, including online through the e-Jagriti portal, to recover the amount with interest, compensation and costs, entirely at your risk as to costs and consequences.
  7. A copy of this notice is retained by me for further action.

Can I go to consumer court without a lawyer?

Yes. A consumer can file a complaint personally, online on e-Jagriti, which replaced e-Daakhil. The District Commission hears complaints where the price paid is up to ₹50 lakh, the State Commission up to ₹2 crore, and the National Commission above that. A complaint should be filed within two years of the problem arising.

Is a notice required first?

It is not always mandatory, but it gives the seller a last chance to settle and shows the commission you tried. Many cases settle at this stage or through the National Consumer Helpline (1915).

Do I need a lawyer to send a legal notice?

No. You can send a notice in your own name. An advocate's letterhead can add weight, and for a large amount or a contested case it is worth paying for advice. Sending a notice does not stop the limitation period, so if it is ignored, file your claim in time.
