Subject: Grievance about rejection of claim under policy no. [Policy no.]

Sir/Madam,

  1. I hold health insurance policy no. [Policy no.] issued by you.
  2. The insured was admitted. I made claim for [Amount claimed].
  3. You rejected the claim, citing: "pre-existing disease or habit not disclosed".
  4. The burden of proving that a material fact was suppressed lies on the insurer (Mahakali Sujatha v Future Generali India Life Insurance, Supreme Court, 2024).
  5. Non-disclosure of a condition unrelated to the claim does not defeat the claim (Sulbha Prakash Motegaonkar v LIC, Supreme Court, 2015).
  6. Para 17 of the Health Master Circular (2024) requires every repudiation or disallowance to be approved by the Claims Review Committee and to give full details, referring to the specific policy terms. Please confirm that this was followed.
  7. Please reconsider and pay [Amount], and reply to me in writing with reasons.

Please also give me:

  1. Confirmation that the Claims Review Committee approved this decision, and the date
  2. The exact policy clause relied on
  3. A copy of my proposal form, and the exact question in it that you say was not answered correctly
  4. The contact details of the Insurance Ombudsman for escalation, as your reply must give them

If this is not resolved, I may approach the Insurance Ombudsman or the Consumer Commission.

Yours faithfully,

How to send and file

  • Letter to the insurer: email it to the grievance address on your policy or CIS, or use the insurer's website. Keep the acknowledgement and complaint number.
  • Bima Bharosa (bimabharosa.irdai.gov.in, 155255): optional tracking by IRDAI. Keep your own email to the insurer too. It never asks for payment.
  • Ombudsman complaint: file online at cioins.co.in/Complaint/Online (attach this complaint, your ID and address proof as PDF or JPG), or email it to your office, or post it signed.
  • Consumer commission instead or after: file on e-Jagriti, within 2 years of the rejection. Usually no fee for small claims. A notice first can help: consumer legal notice.

Free template and timeline, not legal advice. We are not your representative and we can't promise an outcome. For large or complex claims, consult an advocate.

Nothing you type leaves this browser. We can't see it. The Ombudsman and Bima Bharosa charge no fee: anyone asking for money to "fast-track" a complaint is not from them.

What to do when an insurance claim is rejected

  1. Write to the insurer's Grievance Redressal Officer. The Insurance Ombudsman Rules, 2017 need a written complaint to the insurer first (rule 14(3)). Insurers must reply within 14 days.
  2. Wait one month, or until they reply. If they reject your complaint, don't reply within a month of receiving it, or reply and you are not satisfied, you can go to the Ombudsman.
  3. Insurance Ombudsman, within one year. Free. No lawyer needed. Hearings can be by video. The award can be up to ₹50 lakh and binds the insurer, which must comply within 30 days.
  4. Or the consumer commission, within two years of the rejection. Time spent at the Ombudsman does not pause this limit.

Is Bima Bharosa the same as the Ombudsman?

No. Bima Bharosa is IRDAI's portal to register and track a complaint against an insurer. It is optional, takes no payment, and is not a step you must take before the Ombudsman.

Health claim rejected for non-disclosure after years of cover?

Under para 13 of IRDAI's Master Circular on Health Insurance Business (29 May 2024), after 60 continuous months of cover, counting renewals and porting, a health policy or claim can't be contested for non-disclosure or misrepresentation, except on established fraud. Permanent exclusions in the policy still apply.

What if I lose at the Ombudsman?

The award does not bind you. You can still go to the consumer commission, watching the two-year limit.
