Renting in Tamil Nadu
If you are renting in Chennai, Coimbatore and Madurai, Tamil Nadu rules apply. Key laws for residential tenancies here include the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 and the Transfer of Property Act, 1882 (rent laws do change, so check the current position for your city). That Act requires every tenancy to be in writing and the agreement to be registered with the local Rent Authority, so do this in addition to paying stamp duty.
Stamp duty and registration
Stamp duty varies by state: buy e-stamp paper through your state's e-stamping portal or SHCIL before signing, and print the agreement on it. Agreements of 12 months or more generally must be registered at the sub-registrar office under the Registration Act, 1908, which is why many are made for 11 months. This is a template, not legal advice.
Why most agreements are for 11 months
Under the Registration Act, 1908, a lease of 12 months or more generally has to be registered, which adds fees and a visit to the sub-registrar. An 11-month agreement on stamp paper avoids that in most states, and is renewed each year. Maharashtra is the exception: leave and license agreements there must be registered whatever their length.
What goes in the agreement
Term and end date, monthly rent and deposit in figures and words, rent escalation (with a year-by-year schedule for longer leases), who pays maintenance and utilities, repairs, lock-in, notice period, inspection, handover, police verification and a fittings annexure, followed by a signature for every owner and tenant and two witnesses. Co-owners, flatmates, shops and offices are covered.
