LEAVE AND LICENSE AGREEMENT

This Leave and license agreement is made and executed at [city] on ____________________ between:

[Licensor name], residing at [Licensor address], hereinafter called the "Licensor" (which expression shall include their heirs, legal representatives and assigns) of the ONE PART;

AND

[Licensee name], permanently residing at [Licensee permanent address], hereinafter called the "Licensee" (which expression shall include their heirs, legal representatives and assigns) of the OTHER PART.

WHEREAS the Licensor is the lawful owner of the residential premises at [property address], [city], Maharashtra (the "Licensed Premises"), and has agreed to grant a leave and license of the Licensed Premises to the Licensee on the following terms:

NOW THIS AGREEMENT WITNESSES AS FOLLOWS:

  1. Term. The Licensor grants to the Licensee a leave and license to use the Licensed Premises for a period of 11 months, commencing on 01/11/2026 and ending on 30/09/2027. The term may be renewed by mutual written consent.
  2. Rent. The Licensee shall pay a monthly license fee of [amount], in advance, on or before the 5th day of each calendar month.
  3. Security deposit. No security deposit is payable under this agreement.
  4. Escalation. On renewal, the monthly license fee shall increase by 5% over the last paid license fee, unless the parties agree otherwise in writing.
  5. Utilities and maintenance. The Licensee shall pay electricity, water, gas and internet charges as per actual use during the term. Society maintenance charges shall be paid by the Licensee. Property tax shall be paid by the Licensor.
  6. Use. The Licensed Premises shall be used for residential purposes only. The Licensee shall not sublet, assign or part with possession of the Licensed Premises, and shall not carry on any illegal or offensive activity there.
  7. Repairs. Minor day-to-day repairs such as bulbs, fuses and tap washers shall be done by the Licensee. Structural repairs, seepage and major plumbing or electrical faults not caused by the Licensee shall be done by the Licensor.
  8. Lock-in. There is no lock-in period.
  9. Notice. Either party may terminate this agreement by giving 1 month' written notice to the other.
  10. Inspection. The Licensor or an authorised person may inspect the Licensed Premises at a reasonable time after giving prior notice to the Licensee.
  11. Handover. On expiry or termination, the Licensee shall hand over vacant and peaceful possession of the Licensed Premises with all keys, in the condition received, subject to normal wear and tear. This is a license only; it creates no tenancy, lease or other interest in the Licensed Premises in favour of the Licensee.
  12. Police verification. The Licensor shall submit the Licensee's verification details to the local police as required by local rules, and the Licensee shall provide identity documents and photographs for this purpose.
  13. Fittings and fixtures. The Licensed Premises are let semi-furnished. The fittings and fixtures listed in Annexure I, signed by both parties, shall be returned in good condition, subject to normal wear and tear.

Annexure I – Fittings and fixtures

Renting in Maharashtra

If you are renting in Mumbai, Pune, Thane and Nagpur, Maharashtra rules apply. Key laws for residential tenancies here include the Maharashtra Rent Control Act, 1999 and the Transfer of Property Act, 1882 (rent laws do change, so check the current position for your city). Rentals here are usually written as leave and license agreements (Licensor and Licensee), and under Section 55 of that Act they must be registered whatever their duration, even for 11 months. Registration can be done online through the IGR Maharashtra e-registration service.

Stamp duty and registration

Stamp duty varies by state: buy e-stamp paper through your state's e-stamping portal or SHCIL before signing, and print the agreement on it. Agreements of 12 months or more generally must be registered at the sub-registrar office under the Registration Act, 1908, which is why many are made for 11 months. This is a template, not legal advice.

Why most agreements are for 11 months

Under the Registration Act, 1908, a lease of 12 months or more generally has to be registered, which adds fees and a visit to the sub-registrar. An 11-month agreement on stamp paper avoids that in most states, and is renewed each year. Maharashtra is the exception: leave and license agreements there must be registered whatever their length.

What goes in the agreement

Term and end date, monthly rent and deposit in figures and words, rent escalation (with a year-by-year schedule for longer leases), who pays maintenance and utilities, repairs, lock-in, notice period, inspection, handover, police verification and a fittings annexure, followed by a signature for every owner and tenant and two witnesses. Co-owners, flatmates, shops and offices are covered.
